Discipline Programs/Procedures
Expulsion
The Department of Pupil Resources & School Climate oversees all procedures in regard to student expulsion. The department's goals are to:
- Maintain safe and secure campuses for all students
- Ensure fair and consistent use of expulsion
- Properly document compliance with all rules relating to expulsion
Expulsion is the removal of a student from his or her regular school setting for at least one semester for specified types of unacceptable behavior. Some behaviors require mandatory expulsion. These include possession of a firearm, brandishing a knife, selling drugs, sexual assault, and possession of an explosive.
The student is usually suspended the same day as the incident. An expulsion hearing is scheduled within five to seven days, If expulsion is recommended by the Hearing Committee, then that recommendation will be heard by the Board of Education at their next regularly scheduled meeting. The student is considered to be on extended suspension until the Board takes official action.
During an expulsion hearing, the Hearing Committee meets to consider the facts of the expulsion. The student and parents are invited to explain or clarify any matters they wish. After considering the facts and opinions of all parties, the Hearing Committee will decide whether or not to recommend expulsion. If they recommend expulsion, then that recommendation is placed on the agenda for the next School Board meeting. The expulsion hearing allows both parents and students to present their case. If the Hearing Committee recommends expulsion, then parents and students may appeal to the Board of Education at the time expulsion is considered.
During the expulsion period, the child may return to school in an alternative program-continuation school, alternative school, or independent study. A behavioral contract is generally required for alternative placement. Behavioral contracts specify attendance, behavioral, and academic progress that students must make in order to either stay in their current program or return to their original schools.
Suspension Appeals
The Department of Pupil Resources & School Climate oversees all procedures in regard to suspension appeals. The department's goals are to:
- Maintain safe and secure campuses for all students
- Ensure fair and consistent suspension appeals
- Properly document compliance with all rules relating to suspension appeals
Suspension is the removal of a student from his or her regular school setting for up to five days because of unacceptable behavior. The student is usually suspended the same day as the incident. Parents may request a suspension appeal. The date of the suspension appeal can be determined immediately; however, it takes 3 to 5 days for the appeal hearing to take place. Generally, the suspension is over when the hearing commences. A student may return to school when the suspension period has ended.
During the appeal hearing, a panel consisting of the student, parents, school administrator, and the Director of Pupil Services meets to consider the facts of the suspension.
It is possible for a suspension to be expunged from a student's record; but that is usually conditioned upon the successful completion of a behavior contract. A behavior contract specifies attendance, behavioral, and academic progress a student must make in order to have a suspension expunged from his or her record.
